Must know about gratuity

Now their is an Update or Amendment

The limit is not Rs. 350000 its Rs. 1000000.

please suggest me on following query:

i am completed 5 years with same employer but problem is , my co is before 2 years not having any registration we are work on prop., after 2 years registered as pvt. ltd. co ..

so tell me i am applicable for gratuity or not.

In my last drawn salary I have Basic, HRA, Special Allowance & Conveyance. My question is should Spl Allowance be part of Gratuity calculation.
