Simply great info in a great site.

May I know the difference between the two conditions as mentioned in the original post, "CASE-1: You are covered Under the Payment of Gratuity Act, 1971: and CASE-2:  You are not covered Under Payment of Gratuity Act, 1971"

While calculating completed years, any fraction of the year will be ignored. For instance, if the employee has a total service of 20 years, 10 months and 25 days, only 20 years will be factored into the calculation.
 
GRATUITY EXEMPTION:
 

Death-cum-retirement gratuity received by employees of central or state governments and local authorities is exempt without limit.  


Gratuity received under the Payment of Gratuity Act, 1971 is exempt to the extent that it does not exceed 15 days' salary for every completed year of service calculated on the last drawn salary subject to a maximum of Rs.3.5 lakh.  


Any other gratuity is exempt to the extent that it does not exceed one half-month salary’s for each year of completed service calculated on the basis of average salary for 10 immediately preceding months subject to a maximum of Rs.3.5 lakh.  

The ceiling of Rs.3.5 lakh applies to the aggregate of gratuity received from one or more employers in the same or different years.
 
POINTS TO BE REMEMBER:
 

Last drawn monthly salary as on date is taken into account
If total period served with the current employer is less than 5 years no gratuity is payable to any individual
For calculation of gratuity period served at a stretch with one employer is counted
Salary includes only basic pay and dearness allowance
Seasonal establishments are not covered in this calculator
Salary remains same for the last ten month
Only commission on salary paid on turnover basis is included.

How do i know whether i am covered or not covered under Payment Gratuity Act, 1971

What is the procedure to register for Gratuity for the Pvt. Ltd., Company......?

Dear Sir,

One of my friend working in a company.  He joins his Company on 1st August 2004 and willing to resign his company by 31.12.2009.  The duration of his service is 5 year 5 months.  His current Gross salary is Rs.22,000/- and Basic is Rs.11,000/-.  What is the amount of his gratuity?  Is my friend is entitled to receive gratuity from the Company. 

The company in which he is working have not paid gratuity to any employee as yet.  The Employer said Gratuity payment is not  our policy and we are not covered in this Act.  The Employee strength of the company is 125 and six branches all over india.  The Company is dealing with Travel Trade. 

if his  Employer is not willing to pay gratuity. What he have to do for receiving gratuity. Please let me know.

Hello Sir,

One of my Friend was working in a organisation from last 4 years, Joining date was 10-03-2005.

He given resign on 15-02-2010 for One month means leaving date will be on 15-03-2010 but on 08-03-10 he was relieved from post (2 days short for completion of 5 years) (total 4 years & 290 days worked).

Whether he is eligible for the gratuity amount from that Organinsation.
