Minor income - clubbing provision

Tax queries 989 views 5 replies

I have a query regarding clubbing provisions of income tax act. Suppose the parent gifts minor Rs. 1 lac which are in turn invested in bank FD's. Suppose the same earn interest @ 10% of Rs.10,000. The Rs.10,000 are invested by the minor in another FD which again earns him interest @ 10% of Rs.1000.

I am aware that the Rs.10000 will be clubbed alongwith the income of the parent whose taxable income is higher , however will Rs.1000 shall also get clubbed ? Please answer quoting relevant section number / case laws.

Dear nilay, every income will be clubbed (except if earned of personal skill and talent). Hence 1000 will also get clubbed in the parent income whose salary is higher. Regards
Please refer to sec 64(1a).

Thanks Manoj. However, isnt it that only first level income is clubbed & income earned on income is not clubbed ?

No Nilay it is an income which is not earned from talent of child and thus it will be added for sure. Regards

yes this interest of 1000 will be clubbed under sec 64(1a).
