It is not mandatory to File Form 10-IE for ITR-1 and ITR-2 whereas it is mandatory to file Form 10-IE for ITR-3 and ITR-4. However, at present, many of us are unable to file Form 10-IE. Error message appears.

@ Don Titanic To the best of my knowledge, there is no official notification/Circular. However, it is not possible to file Form 10-IE in the portal for ITR-1 and ITR-2. The Portal has been designed like that. At the same time, for ITR-3 and 4, due to technical glitches, we are unable to file Form 10-IE, though in the past, some were able to file the same or ITR-3 and 4.

It is mandatory to file Form 10 IE for claming 115BAC even for ITR 1 and 2.

It requires to mandatorily enter the Business/Profession Details. Hence, it's designed for ITR 3 and ITR 4 filers...

Form 10IE is a declaration made by the return filers for choosing the 'New tax regime'. The taxpayer has to communicate the selection of tax regime by sending an intimation through Form 10IE to the income tax department before the filing of ITR. The new tax regime is applicable from the FY 2020-21, i.e. AY 2021-22

In Online mode of ITR-2, there is only one line question of new tax regime. No separate form called 10IE appears to fill up anywhere.

Techinical Issue. but as per Act, we need to file Form 10IE. There is no notification for exempting non filing for ITR1 and 2.

I have chosen the "Opting for new regime under section 115BAC" as "yes" and also filed the ITR-2 on 9th August itself.....But when I try to fill form 10IE, after entering the verification OTP, the error message appears...Is it because I am filling form 10IE after filing returns?

How do you will Form 10-IE for ITR-2? The form as given in the portal will ask you to choose business or profession. It is because of this reason, many assessees do not file Form 10-IE for ITR-1 and 2 but claim the benefit in return itself.

So, there is no need to additionally fill form 10IE in case of ITR1 and ITR2...
