Income taxability of minor

A minor was earning income from the property transferred from his father and his income was clubbed with his father. But his father died and his mother also died. So with whose income the minor income shall be clubbed and how his return will be filed.Give reply with suitable references.

If both the parents of the minor child are not alive, then the income of minor child cannot be clubbed and the guardian of the minor child shall file the return on behalf of the minor. It may be added that it will not be included in the income of the guardian if the guardian is not a parent.

FULLY AGREED WITH ABOVE.

will be clubbed with the guardian if they are legal guardian else minor has to file his own return...

There is no section or provison under incme tax for clubbing with the guradian even if both parents die...yes
