Dear All

I want to file annual RoC returns for a new company incorporated on 5th april 2009. The annual accounts are ready for Ay 2010-11 and ITR will be uploaded soon, in a week. AGM already held on 31/08/2010. Now my question is what is the last date by which i should file the forms namely 20B, 23ACA, 23AC. and what if, if I fail to file the returns within due date

dear nihit,

Form 23AC & 23ACA for balance sheet need to be filed within 30 days from the date of AGM and form 20B for Annual return need to be filled within 60 days from the date of AGM. If u fail doing that u can file the same with additional fees.

For the Financial Year 2010-2011, how you can adopt Annual Accounts.

Dear Nihil,

Under Companies Act term Financial Year is used. Assessment Year is only related to the Income Tax Act.

Futher, in relatin to the annual accounts for the financial year 2009-10 which you have adopted on 31/08/2010. The due date for filing Balance Sheet in form 23AC and 23ACA is 29th of September, 2010( i.e. within 30 days from the date of AGM) and for Annual Return in form 20B is 29th October, 2010 (i.e. within 60 days from the date of AGM).

Form 20B - Within 60 Days of AGM i.e. 29/10/2010

Form 23ACA & Ac : Within 30 Days of AGM i.e. 29/09/2009
