Duty draw back claim - epcg reg.

Dear Sir,

We are one of the supplier of wind mills and had supplied wind mill to of a client(purchaser), who is an EPCG license holder. We(supplier) have not taken any advanved authorisation for supplying wind mill, and purchaser has obtained invalidation letter, for claiming duty draw back.

To claim duty drawback, we were informed by DGFT officials, that as per DGFT circular No.9, dt.01/10/2009, ARO document is needed for this process. But I was in an understanding that even, invalidation letter can be used for draw back claim, which is not accepeted by DGFT. ( One of my friend informed, that earlier DGFT accepeted invalidation letter, for this purpose)

Can you pls help me, whether ARO (or) invalidation letter should be the right document, to be submitted for claiming duty draw back as per current norms, for our case?

Amazing, Good shot by DGFT officials, You can also throw the googly and say that this circular doesn't talk about EPCG or its paragraphs.

We can talk about this if you can send me the deficinecy letter.
