I have received a dividend for Siemens Germany and they have taxed me 26.4 % I have become a resident in India and falling now in 30% bracket We have data with Germany and u/s 90 can I claim refund or have to pay balance 3% more + surcharge- not clear

divident is taxable if paid by foreign company

and in india u can get relief if any tax paid in foreign country

povided Agreement with Foreign Countries or specified territories

but u have proof of tax paid and copy of return of concern country

Not clear- I know foreign dividend is taxable- again my question- they have with held- WHT- 26.4% Is it high as per DTAA?- can I claim refund? Or I have to club it with my Indian income and get taxed at 30% paying balance 3.6% I have become a resident this year onwards- AY 2017- 18 Tax bracket 30% If it is a clear answer - please post- not simply say taxable-- all know this If any tax expert in this forum can give advice- u/s 90 etc- preferred Thanks
