Can moa aoa be dated 12th may or any date before 12th may or it should be necessarily be 13th may after estamping ??

MOA and AOA should be dated 12th May, 2012 or the date before 12th May, 2012.

However MOA and AOA should not be dated 13th May or after that date.

THE MOA/AOA may be signed on any date but before filing of Forms and paying the stamp duty and after the name has been approved. as the stamp duty is paid on MOA AOA duly signed. So these must have been signed duly before payment of stamp duty.

Genarally, documents are executed, after stamp duty is paid on it. (like in case of partnership agreement, sale agreements). However, while incorporating a company, a stamp suty is paid only after we upload all 3 forms (1,18,32) and one of the attachments to form1 is moa & aoa. So it has to be signed and dated when u upload it. And if you upload a future dated instrument, it would be sent for re-submission, if the ROC official recognises the mistake.
