Confidentiality of data uploaded with mca - pvt companies

Dear All,

With the new Companies Act in place, various resolutions, documents etc., have to be filed with MCA for private companies. What is the confidentiality of such uploaded? Can anyone download such data from the MCA website. Also can such data downloaded be used as evidence in the court of law?

I don't think we can download the datas of private companies from MCA.

Office of ROC is a public office.  The very purpose of filing various documents is to make the same available for public inspection.  Anyone  from public can make online inspection of documents of any company on payment of fee of Rs.100+service tax and download the same.  Private company is not an exception.  On the contrary, under Companies Act 2013 even P&L statement is no more confidential (It was so under CA 1956).
