Facts: i
1. The appellant was heard on 13/7/2009 through a representative.
2. The appellant has asked for a copy of the evaluated answer sheets in respect of a final examination, in which she appeared.
3. The CPIO and the Appellate Authority have replied but refused to provide the requested information, without indicating the provisions of the RTI Act under which exemption from disclosure of answer sheets has been claimed by the respondent.
4. During the hearing, the appellant cited a few decisions of this Commission, whereby the disclosure of evaluated answer sheets has been allowed. He also presented a news report, which confirmed that a Commission’s decision challenged by the respondent before the High Court of Delhi in an identical case of disclosure of answer sheets has been upheld.
Decision:
5. The appellant has asked for a copy of her own evaluated answer sheet. The CPIO and the Appellate Authority have not indicated the provisions under which they have claimed exemption from disclosure of the information. An examinee has the right to access the evaluated answer sheets so as to make self assessment of her performance. In view of this, there is no justification for denial of the requested information. The CPIO is, therefore, directed to furnish the requested information within 15 working days from the date of issue of this decision, failing which penalty u/s 20(1) of the Act would be imposed.
6. The appeal is thus disposed of.

Its a good decision as it will bring transperancy in the marking system and pasiing students.
But the Institute is planning to bring about an change by asking the parliament to change the regulations and allow the present system to continue.
We have to wait and watch and hope for the best regarding this decision.

Dont expect that the institute is going to favour the interests of the students.In the recent past ICAI has showcased the greatest shots of biasedness that an institute regd. under an act of parliament can.

this will result into lot of work, majority of the students fail in the exams and if most of them apply for assessment than i think it will take a lot of time and our exams are fixed every 6 months and v have 3 months after result to study now,
one has to start studying after result they can not wait for the assessment,
and even after assessment what is the guarantee that he will pass.......,(they will increase the marks dnt knw??) so still even after assessmnet if ur fail whats the point in gng for so long procedure better dnt waste time and start studying,and if ur answer is right but marks alloted to u are not satisfying whats r the options available for u??
if such things happen than i think that exam papers will be much harder compared to now......
institute fails most of the people and also i have seen many variations in the marks obtained by the students but they have to fail them that’s y v r in demand and its such a good profession, only those who has a strong will power, determination can pass out this exams v should take it as a challenge......
even I have experienced it during my studies but I accepted it as a part of my career and if ur intension is to verify ur answer sheet than u knw what u have written in the exam paper compare it with suggested answer available with the institute….. moreover u can view only ur paper not of others so u dnt knw how markes have been alloted to other students......
for me what are the options available to the students after assessment is more important than just verifying ur answer sheet........i would have not opted for the assessment thats my personal view.
