Sir, in the above connection, you are informed that under section 8(a) and para 30(3) of the Employees' Provident Fund and Miscellaneous Provisions Act, 1952, the responsibility of ensuring PF compliance of the employees employed through the mill rests with the principal employer and Miller is of both.
Be aware that CGMARKFED is a unit of the State Government and is the main employer registered under the welfare schemes of the Act, by whose contract if any regular/temporary/casual/part-time/daily wage laborer is employed through the miller, he/she will be entitled to PF. Membership is mandatory. The limit of 20 employees in government establishments is applicable to the principal employer and not to each paddy mill individually.
It is the responsibility of the miller to ensure compliance of all laws by the principal employer as per the terms of the contract. According to the information received from CGMARKFED, the contract details of your mill are attached, which clearly shows that the mill is functional and workers are employed in storage, transportation and processing etc. Therefore, it is the statutory responsibility of the miller to immediately apply automatically to make the eligible employees members under the Act.
It is directed that within 7 days you may visit www.epfindia.gov.in or https://registration.shramsuvidha.gov.in/user/login and start complying with the Act as per the rules by taking registration code and also the undersigned Immediately inform in this regard by letter to do.bilaspur @ epfindia.gov.in.
Please also note that in the event of non-compliance of the Act, there is a provision for investigation and initiation of action under section 7A to determine the liability on the defaulting establishment.
