Amendment in PAN

What is the procedure of amendment in PAN? A co-operative society was wrongly registered with IT Deptt. as Company. Now it want to correct its PAN to that of co-operative society. What documents need to be attached with the PAN amendment form?

As in PAN Correction Form, there is no provision for change of constitution, i m not sure how to correct error in ur case. But u can try as under -

i) Fill up PAN Correction Form

ii) Attach Copy of Certificate from Registrar of Co-op. Scy.

iii) Attach copy of existing PAN Card alongwith breif note below PAN Card stating that PAN Application for Co-op Scy was made inadvertently as Company. Hence, PAN data correction is required changing status of assessee from Company to Co-op Scy (AOP)

iv) Try to submit above mentioned docs with NSDL. If they accept, ur error will be rectified.

Here the question arise whether the documents submited by you along with the form where correct or not, if the mistake is on the part of PAN issuing authority you may contact the PAN issuing authority and get the same rectified, definately they will do the same and guide you on the procedure to be followed.

By whom the PAN Amendment form be signed - by Director or by manager of the society?

Noramlly PAN can not be corrected. U can correct name, age, father name, mismatch of signature and photo on PAN correction Form quoting your PAN on Form with necessary proof. Therfore it is suggested U to surrender your PAN Card which is alloted as company with covering letter, and mention as it given wrong status by the NSDL or UTI and U apply fresh with required documents. Any Authorise person can sign Application. In practice we hav seen that amendment is PAN is more difficult.

First of all without a certificate of incorporation of a COMPANY, the department cannot issue a PAN Card on basis of company. Obviously the society has given its registration certificate of society as proof. Therefore if society had wrongly applied as company the application ought to have been rejected. On the other hand if society applied correctly the department may have committed the error. In either case, fill the Change of PAN Data form online and send supporting documents to NSDL. Let them reject it and then you start asking them what documents to provide to effect the change.

.change of Data Form will not serve ur. pupose. PAN cannot be corrected . 4th alphabet of PAN indicate the status of person . Therefor U follow the procedure as I replied earlier.

the PAN card covering letter is issued by the agency on behalf of department. U can not get same. U can dowload NSDL / UTI allotmernt letter from their website

Whatever it is the error is either of Society or of Department. If it involves change of 4th letter the least cumbersome process is toapply for a new PAN first in the name of the Society and on Basis of SOCIETY. Then you fill the PAN surrender form for the wrongly alloted PAN. It is not possible to surrender a standalone PAN but if you take a new PAN, you can show that that is the PAN in use and surrender the wrong one. If there are 2 PANs department allows you to surrender one of them only. If there is only one PAN then it does not allow a surrender. Ther worst is they can issue a show cause notice for Penalty but usually you are given an opportunity to be heard in which you can make your submission.

I have received my Pan card but now I want to correct my nationality as it was wrongly filled earlier .Can the same be done ?

Yes. Fill in the change of PAN Data form at NSDL. You will have to check mark against the item that requires correction. You have to send them the identity proof that will show both your name and nationality.

Thats the confusion , there is no check mark for the nationality column in the form .

Dont lose your sleep on it. If you are an Indian and you go to US and take nationality there, your PAN of India will remain as it is and not change. Only your residential status will.

Fortunately, for INDIVIDUALS income tax is a residence based levy. For Companies, tax rate differs between domestic and foreign. Therefore as far as revenue is concerned you are not under any violation.

Now you have to get the nationality corrected because you signed your application with 'To the best of my knowledge and belief' just above your signature. What you made is a bonafide error and not done anything to evade taxes or such things.

There is one thing which is above all application forms. A PLAIN PAPER application. But this has to be done personally and you can do it with interaction with a single human being on the other side and not collectively with what is called a department. Call NSDL and explain your situation. Follow it with written communication. If you can, visit personally. As long as there is no difference between an Indian and Foreigner as far as quantum of tax is concerned there is no problem. The day there is such a difference, you will have problems.
