About me

   I am a retired Assistant Commisioner of Commercial Taxes of Karnataka. I retired in 1998 at the age of 58.During this service I tried to go in detail about sales tax laws. Immeadiately after retirement some companies wanted to retain me  as their consultant. That is how my touch with the subject of VAT laws continued.The website of CAclub india is giving a good opportunity to share my knowledge with others. I am an exserviceman from IAF. So, Iam a little different from other taxmen. We should do some service to the community that has offered us so much, That is my purpose.....Bye.

    I have already replied to your query. Sec20 and 30 deal with penalties and interest when certain sales are not reported and taxes are not paid in time. When such sales are included in the main branch accounts and reported, then no offence can be booked. But for doing business in an undecared place a penalty of Rsfive thousand can be levied U/s 20,if noticed by the department.....MJK

    Yes,but when you enter into an agreement for buying an apartment or make payments before completion of the apartment building.If you buy after completion it becomes a sale of an immovable prperty and no GVAT on it. When a builder recives instalments before completing construction,which is generally the case with all builders,he has pay tax on the construction cost both VAT and ST as per rules....MJK

    Service Tax is again @4.12 of construction cost only. So it may come to around 2% of the total price only
