DEAR SIR, IN OUR CASE, WE ARE THE EXPORTER. NOW OUR FOREIGN BUYER WANT THAT HE WILL SUPPLY RAW MATERIAL TO US AS FREE OF COST,AND WE CHARGED OUR COMMISSION FOR PROCESSING. NOW OUR FOREIGN BUYER SUPPLY RAW MATERIAL TO US WHICH HE WILL PURCHASE FROM AN INDIAN COMPANY IN INDIA.PAYMENT WILL DONE BY OUR FOREIN BUYER IN FREEY FOREIGN EXCHANG.. NOW IN OUR CASE WHICH POLICY IS MORE BENIFICAL TO US. AND CAN WE GET ANY DRAWBACK BENIFITES.

Kindly advice whether a manufacturer registered under CE Act,1944 can clear excisable material through duty free invoice to SEZ unit through third party. Say, X Ltd. registered under central excise and S Ltd.is an SEZ unit. S gives an order to T (a third party) for an excisable material.T gives order to L(another third party) L wants to procure such material from a dealer of X Ltd. Now,the issue is whether X Ltd. can remove that excisable materials to S Ltd. as duty free export(deemed export). Can S Ltd. provide certificate of development commissioner to procure the material through third party and from a dealer(1st stage) of the manufacturer(X Ltd.).
