In its recent 51st meeting, the GST Council proposed some important changes to the CGST Act 2017 and IGST Act 2017. These changes are aimed at bringing more clarity to the taxation of certain activities like casinos, horse racing, and online gaming. Let's delve into the key recommendations made by the council.

Taxation of Supplies in Casinos, Horse Racing, and Online Gaming

One of the main focuses of the meeting was to provide clear guidelines on how supplies in casinos, horse racing, and online gaming should be taxed. This is important to ensure fairness and transparency in these industries. The council recommended amendments to the CGST Act, 2017, and IGST Act, 2017, including changes in Schedule III of the CGST Act. These changes will help in better defining how these activities are taxed under the GST regime.

Online Money Gaming from Overseas Suppliers

The council also discussed the taxation of online money gaming provided by suppliers located outside India to individuals in India. To simplify this process, a new provision will be added to the IGST Act, 2017. This provision will outline the liability to pay GST for such online money gaming. Additionally, a simplified registration scheme will be introduced, making it easier for these overseas suppliers to register in India. To ensure compliance with registration and tax payment, there will be measures in place, including the blocking of access to certain online resources if the supplier does not comply with the rules.

Valuation of Online Gaming and Casino Activities

Valuing supplies in online gaming and casinos is an important aspect of taxation. The council recommended a specific approach to valuing these supplies. Instead of considering the total value of each bet placed, the valuation will be based on the amount paid or payable to the supplier by the player. This excludes any amount that comes from previous winnings and is used for placing new bets. To implement this valuation approach, amendments will be made to the CGST Rules, 2017.

 

Bringing the Changes into Effect 

The council is determined to implement these changes as soon as possible. Efforts will be made to complete the process of amending the acts, rules, and notifications by 1st October 2023. This timeline reflects the council's commitment to making the taxation process for these activities more clear and effective.
