Government Contemplates Allowing Revised GST Returns, A Boon for Taxpayers

The Government is reportedly considering permitting the filing of updated or revised returns under the GST. This proposal, once implemented, is expected to not only benefit taxpayers but also contribute to a reduction in litigation related to the GST regime.

As per the proposal, taxpayers will have the opportunity to rectify various aspects of their returns, including the computation of taxes. Currently, there is no provision for filing revised returns under GST, except for minor corrections in invoice details. Industry stakeholders have long advocated for this feature, with a petition on the matter already before the Supreme Court.

Taxpayers Likely to File Revised GST Returns Starting April 2025

A senior government official revealed, "We are looking at allowing updated returns under GST," highlighting the potential positive impact on the ease of filing returns and a decrease in litigation, particularly in cases where there is no intention to evade taxes but rather errors in calculation or omission of details.

The Central Board of Indirect Taxes and Customs is actively working on the details of this proposal, which will subsequently be reviewed by the law committee of the GST Council and the council itself. Initially, the facility may be introduced for yearly returns, with a subsequent expansion to quarterly returns. However, it is expected to take at least 8-9 months post GST Council approval for implementation due to the need for a substantial upgrade of the GST Network.

The GST Network (GSTN) is set to entrust the task of upgrading the GST portal to the next technology vendor, as the current contract with Infosys, the existing service provider, concludes on September 30, 2024. An official from GSTN stated, "If everything goes smoothly, we will be able to implement the new facility by April 2025."

Experts in the field emphasize the importance of timely updates to GST return forms, aligning them with the evolving fiscal landscape. They suggest that the introduction of revised returns would be especially beneficial for businesses dealing with natural human errors, such as calculation mistakes and counting inaccuracies. These errors could be corrected if an option for revised returns is made available, along with pre-filled returns.

One expert highlighted the necessity for real-time data processing, validation, and the ability for businesses to edit all fields in auto-populated returns. Additionally, he stressed that tax payment computations should be based on the data populated by the business. The proposed move aims to strike a balance between compliance, convenience, and accuracy in the GST filing process.
