State Tax Department Recovers Rs 11.18 Lakh Penalty in Major GST Violation Case

In a major enforcement action, the State Tax Department of Jammu & Kashmir (J&K) has realized a penalty of ₹11,18,068 from a taxpayer for violating Goods and Services Tax (GST) regulations related to the transportation of rigid tubes, pipes, hoses, and fittings made of propylene polymers.

Tax Evasion via Fake ITC Detected

Acting on specific intelligence inputs, the Enforcement South Kashmir team set up a special naka (checkpoint) and intercepted a vehicle involved in a fraudulent Input Tax Credit (ITC) transaction without the actual movement of goods. The investigation revealed the involvement of three taxpayers in the evasion scheme.

Further scrutiny found that a Delhi-based firm had issued two e-invoices and e-way bills worth ₹73,29,554 to two taxpayers. However, the actual value of the goods being transported was only ₹36,64,777, indicating an attempt to pass fake ITC.

Swift Enforcement Action by the State Tax Department

The enforcement drive was led by Anil Kumar Chandail, Deputy Commissioner, Enforcement South Kashmir, along with a team of State Tax Officers (STOs), Inspectors, Sub-Inspectors, and security personnel. The action was conducted under the guidance of P.K. Bhat, Commissioner, State Taxes, J&K, and Pervaiz A Raina, Additional Commissioner, State Taxes, Kashmir.

Commissioner P.K. Bhat and Additional Commissioner Pervaiz A Raina commended the South Kashmir enforcement team for efficiently handling a significant case of GST fraud. They reiterated the department's commitment to strict tax compliance and cracking down on fraudulent practices involving fake ITC claims.

"The department is committed to fostering a culture of accountability and transparency. Such enforcement actions will help neutralize tax evasion networks and ensure strict compliance with GST laws and rules," said Additional Commissioner Pervaiz A Raina.
