Major GST Refund Scam Exposed: Rs 42 Crores Under Investigation

In a significant breakthrough, the Commercial Taxes Department has uncovered a massive GST refund scam, exceeding ₹42 crores, sending shockwaves through the financial sector. The investigation has led to eight cases being probed, with at least one individual already arrested and presented in court.

The investigation, characterized by its unwavering commitment to justice, was a collaborative effort between the Commissioner of Commercial Taxes and the Joint Commissioner of Madhapur. Their relentless pursuit of truth shed light on a complex modus operandi that defrauded the government.

The modus operandi of the perpetrators was astutely deceptive. They meticulously fabricated purchases of auto spare parts and the subsequent transportation of these parts via trucks, even producing waybills to support their claims. These parts were then allegedly assembled into electric bikes, forming a basis for a GST refund. However, the reality was far from their claims, as there were no genuine purchases, no transportation, and no actual assembly of electric bikes. Furthermore, there were no legitimate sales; the entire operation was based on bogus documentation, all in a concerted effort to fraudulently claim a 13% GST refund, as revealed by T. K. Sreedevi, Commissioner of Commercial Taxes.

Upon the discovery of this elaborate deception, the department promptly mobilized teams to identify and track down the accused. Their tenacious pursuit of justice led them to leverage banking records and Know Your Customer (KYC) details to apprehend those responsible.

The accused masterminds projected their fraudulent scheme based on the premise of purchasing auto spare parts, subject to a 5% GST rate, and subsequently selling them to qualify for an 18% GST rate, thus enabling them to claim a 13% refund.

One of the prime suspects, identified as a director of Vinardh Automobiles Pvt Ltd, has been apprehended and presented before an economic offenses court. Authorities are now diligently working to recover the substantial amounts fraudulently claimed as refunds, with notable progress already being made.

In a strategic response to prevent such schemes in the future, a circular issued on October 9 by Dr. Sreedevi has outlined a new process for processing and sanctioning GST refunds. This significant reform mandates that Assistant Commissioners or Deputy Commissioners of the relevant circle, regardless of the refund amount claimed, will oversee the process. This shift is aimed at bolstering scrutiny and preventing the sanctioning of fraudulent or ineligible refund claims that often involve substantial sums. It underscores the department's unwavering commitment to protect public funds and maintain the integrity of the GST refund system.
