Delhi HC stay on disclosure of answer sheets of CA exam

While considering an appeal filed by a student of the Chartered Accountants Examination under the Right to Information Act, 2005, the Central Information Commission recently ordered for supply of certified copies of the answer sheets of a student concerned which was also later confirmed by the Learned Single Judge of Hon’ble Delhi High Court in respect of a Petition filed by the Institute. Consequently, queries are being received by the Institute about the supply of answer sheets.In this connection, it may be mentioned that subsequently, an appeal against the above Order of the Learned Single Judge was preferred by the Institute before the Division Bench of the Hon’ble Delhi High Court and the Hon’ble Bench has been pleased, among others, to stay the said order of the Learned Single Judge. As such, the matter is before the Hon’ble Division Bench of the Delhi High Court.

in my opinon its not possible for insti to set the level of checking by personaly conveying to each moderator.....thus i think institute is using Standard deduction system.......that means they allow moderator to check the papers as per their wish.....then while feeding the marks into system they used the standard deduction for all as per requirement........

I seriously feel that there is something wrong with evaluation system of ICAi exams as many of my peers who have gone for revaluation of thier paper have got sometimes more marks after revaluation and have passed also so how come the earlier evaluation of paper did not passed them and now they pass after revaluation. there s no proper justification fot ICAI to give for not showing our answer sheets

Almost all the students who asked for answer sheets for their exanmination should hear well that our exam corrections are arbitrary in nature no two same answersheets corrected by 2 different examiners will have the same marks awarded and our institute has a beautiful mark moderation technique ..it is the unique technique to squeeze the results or inflate it,i think it is the best moderation that can be found in any educational courses in this country...this mark moderation increases with the number of attempts taken by students...it will be hell if a student comes to know that he skipped to 45 from 55 due to moderation and another student skipped up from 56 to 63 or 66 due to mark moderation...but this moderation is done on an impartial basis taking slab of same category students with that number of attempts....so a student who has attended 6 exams unsuccessfully will have to score 77 marks to come down to 60 but a new student who scores 56 will easily reach 60 . hence showing answersheets will put ICAI in an embarassing situation. so the only alternative is to pray god for good luck,work hard and wait for the results....

no institute wont allow the answer sheet to be displayed bcos it is a sujective test....and marking is done arbitrarily......again next stage is moderation. hence it will be a hell when a student who scored 55 marks was brought down to 45 and a student who scored 56 was lifted to 63.....Th a game of luck plus effort.....no one knows who will be the winner.....This is the whole story...

If the Institute is confident about the accuracy of results it gives then it should not have any problem in showing the assessed marksheets to the students. If it refuses to do so, then it clearly shows that they are not confident about their Results.

since institute is regularly forcing business and profession to disclose various financial datas in Reporting their operations. But it itself denied to report their operation in examining Answer sheet.

Ya.. the Institute sholud make all attempts in this regard and produce the copies of answersheet.. its the students right! the courts should take appropriate decision and favour the student community

The answer sheet must be shown to the students. It really feels bad when you are expecting an exemption in Tax and I.Technology in PE 2 and end up getting 45 and 39 marks. Really, controlling the percentage of results is a bad practice. I hope the court takes a decision in the favor of the students.

Hi, Respected Chairman, It really feels bad that when u secured 73 marks in your tax paper of PE-2 and you cant see that paper also, i request you too please allow us to get a copy of paper. CA exam is not just a exam but the toughest exam, that we all belive and then getting good marks in that but cant see those paper feels relly sad i have just got 73 in Tax,66 in Audit, 60 in I.Technology, but still cant see those paper, then how those people who are rank holder must be feeling, because for ICAI there are many rank holder , that come every attempt and go but sir for us it is a life time cchivement so please i request u to allow us to get a copy ofour paper from all my brother and sister who are doing C.A. Govt and other all public organisation must be transparent for every citizen of country. If anyone feeling something wrong with him he must be satisfied. The authorities may think that same thing may happen with them. May be everything fair but we may satisfy by transparent working. It is my personal experience that some fellows are making complaints for wrong evaluation of answersheet in one exam I intervened in the matter and arranged answersheets under RTI Act 2005 and now there is not complaints. We may go in positive way if we are doing right.

@ Sushma - Just think about that person who failed exam and made application to high court....why is he doing this....?only when he feels that he deserves something else....else who will take so much pain in filling suit and all....so its not that because he failed he has filled suit....sometimes seriously smart people fails CA exam and i hope everybody knows whos responsible for it.....

Pass out a exam is a right of every person who gives exam and who is genuinely smart & talented....so if 1 student feels that he/she is missing out in something then he/she should be allowed to see answersheets.....

When all other institutes & University distributes marksheet then why not ICAI...???The toughest exam in India is CAT & even its answersheet is available under right to information act then why not CA exam answersheet....there is a huge number of people who will agree with me on ICAI restricting results as they want....otherwise tell me one thing that is there only 10 to 20 % students are tellented to pass CA exam in every attempt....?not possible na....just think....showing of answersheet will increase results...this will harm ICAI's reputaion of being called as 2nd toughest exam in india after CAT.....

@ Loveleen - Its a myth or truth in the finance industry that ICAI restrict results as per their requirements. ICAI should prove all this wrong by showing marksheets to the students. There are hell lot of departments in ICAI and they can setup a new department for this service. They should charge for this. Its not that because of this ICAI will conduct exam once in a year. They can do if they want to do but they don't do generaly in favour of students. Best example is restriction on transfer.

@ Santoshkumar.....I am not denying about the method of examination and all....Its just the question of showing the marksheet to the students....Anybody please tell me 1 reason for not showing students their marksheets.....

I am very much satisfied by the AKSHAY's comment that the answer should be shown to the student who have failed to pass the examination, because they are the wto will get the benifit. I mean to their is no harm in showing the answersheet.It Will the move that the will be welcomed by all of us.

SHOWING ANSWER SHEETS IS A QUITE A QUESTIONABLE ISSUE.......SHOWING SHEETS IS BOTH CONTROVERSIAL FOR STUDENT AND INSTITUTE......ONLY THE STUDENT WHO HAVE HAVE FAILED IN THE EXAM WOULD WISH MORE TO SEE HIS ANSWER SHEET, SO FRIENDS JUST UNDERSTAND THAT IF WE FAIL IN OUR EXAM WE HAVE JUST ANOTHER 3 MONTHS TO PREPARE FOR OUR NEXT ATTEMPT AND AS YOU KNOW IF INSTITUTE KEEP SHOWING ANSWER SHEETS TO EACH AND EVERY STUDENT, HOW MUCH TIME CONSUMING IT CAN BE AND OUR ANOTHER ATTEMPT WILL GO PASS AWAY AND ULTIMATELY THE NEXT ATTEMPT AND OUR MARKS ARE BOTH CONTROVERSIAL AND THE ULTIMATE SUFFEROR WIL BE THE STUDENT ONLY....

Well by the comments given here by most of my friends seem quite vauge....I think we all know now difficult our exams are and how we have to prepare day in and day out to get the results and if after giving a good exam, we dont get good enough marks...there should be special provisions made for showing the answer sheets....not that it should be shown to everybody...say if a person has failed in 3 subjects...he is a failure...but if a person has got good marks in all other subjects and has just failed in one subject....you have to consider his request....may be the requisite fee for such a service should be kept as high as 2,000/- or more so that only the most confident persons will apply to see their answer sheets....but merely saying that this will increase controversies...is ridiculuous...i have been in this situation and I understand....but yes any middle of the road decision should be taken...so that no one is left aggrieved...further....why are only the students held liable....why isnt the Institute liable....for students there is a penalty in Rupees if they dont submit papers in time, or else they have to obtain special permission...why isnt there such a provision for the Institute for any delays..in not communicating the articles termination, articles completion letters and other communication....I am saying these things....because being a member of the ICAI family...i have to suggest ways for betterment of wrong systems, i would also go to the extent of making a student grievance redressal body...so that all inefficiences in the system are removed and our ICAI becomes more and more powerful in future.

I feel the person who has filed for the lawsuit was unsuccessful in the examation. Since we rarely hear about people who have passed out questioning the institute. There is nothing wrong in asking for a copy if the student is really confident about the answers he has written. However, in my personal opinion I think people should move on instead of holding on to a failure. I know how it feels when you come out of the exam hall thinking "YES" I have done well and see the actuals with sinking heart.With my personal experience I feel it is better to forget the attempt gone wrong and try again without all these negative feelings in the heart.
