CMA institute to no longer use the acronym ICAI after Delhi High court order

Last updated: 14 June 2023

The Institute of Cost Accountants of India (ICMAI) has decided to no longer use the acronym ICAI after the Institute of Chartered Accountants of India (ICAI) won a trademark infringement lawsuit against them. The Delhi High Court issued an interim order on March 21, 2023, restraining the ICMAI from using the acronym ICAI. The court gave the ICMAI three months to remove the acronym from all physical and virtual media, including websites and social media platforms.

The ICAI has been using the acronym ICAI since 1949. The ICMAI was founded in 1959 and started using the acronym ICAI in 1972. The ICAI filed a trademark infringement lawsuit against the ICMAI in 2022. The ICAI argued that the ICMAI's use of the acronym ICAI was causing confusion among the public.

The ICMAI has said that it will comply with the court order and remove the acronym ICAI from all physical and virtual media. The ICMAI has not yet announced a new acronym.

The decision by the ICMAI to no longer use the acronym ICAI is a significant development in the accounting profession in India. The ICMAI is the second largest accounting body in India, with over 1 million members. The decision by the ICMAI to no longer use the acronym ICAI could have implications for the way that the ICMAI is perceived by the public and by employers.

The decision by the ICMAI to no longer use the acronym ICAI is also a reminder of the importance of trademark protection. The ICAI was able to successfully defend its trademark against the ICMAI because it had registered the acronym ICAI as a trademark. Businesses should take steps to register their trademarks to protect their brands from infringement.
