Bharti Airtel Secures Major Relief as GST Demand Slashed to Rs 194 Crore from Rs 604 Crore

Last updated: 26 August 2024

The Central Goods and Service Tax Appellate Authority in Delhi has ordered Bharti Airtel to pay Rs 194 crore in GST on licence fees and spectrum usage charges, significantly reducing the original demand of Rs 604.66 crore. The demand was initially made by the GST Department under the reverse charge mechanism, based on a demand note issued by the Department of Telecommunications (DoT).

Bharti Airtel, one of India's leading telecom companies, had appealed against the hefty GST demand, arguing that the charges were unjustified. The company's appeal led to the reduction of the demand by the Appellate Authority, which passed its order on August 21, 2024.

The company is currently assessing the impact of this order and is expected to take appropriate legal and financial actions in response. This development is critical as it highlights the ongoing complexities and disputes surrounding GST obligations in the telecom sector, especially concerning licence fees and spectrum usage.

This case also underscores the challenges faced by telecom operators in navigating the regulatory landscape, where large sums are at stake in tax disputes. Industry experts believe that this ruling may have broader implications for other telecom companies facing similar GST demands.

For Airtel, the reduced liability is a partial relief, though the company may still explore further legal options to contest the remaining amount. The outcome of this case could set a precedent for how GST is applied to telecom services in India, particularly in relation to charges levied by the DoT.
