Withholding tax in thailand

Sir

My client is a resident in India in F y 2015-16. He owns some property in Phuket (Thailand). Now he is going to sell that property and he will pay withholding tax of 5.00 lacs thai Bhatt in Thailand

Can he claim credit of tax paid in Thailand while filing return in India

Dear Sir

 

India has signed a Comprehensive Agreement with "The Goverment of the Kingdom of Thailand" to avoid the double taxation effect.

As per Article-6 & and Article-13 of DTAA the Income Arise in the Contracting Country may be taxed in Contracting Country.

And as per Section 90/91 of Income Tax Act 1961 you can claim the benefit of DTAA for the Taxes paid in the Contracting country (i.e. Thailand)
