Whether income is taxable in india?

Tax queries 203 views 1 replies

Hello tax experts.. I need your valuable decision.

A person who worked in India for almost 10 months and went to Japan country on 02-02-2017 and working under a employer who is a resident of Japan. When coming to Income Tax filing whether income earned in Japan for February and March 2017 are taxable in India or Japan? I've referred DTAA between India and Japan but couldn't assure myself for the conclusion I've arrived. So please guide me in this regard.

a) Whether taxable in India or not?

b)If yes which ITR form is to be used and how to take the credit for tax paid in Japan?

c) Any other procedures and provisions to be followed?

For your reference I'm attaching the DTAA between India and Japan.

Thanks and regards

Income is taxable in India as person is resident of India, hence his global income is taxable unless he is RNOR. Note:DTAA decides foreign tax credit applicability. Take relief under section 90/91 if foreign taxes paid.
