As per Notification 46/2017 CT (r) its 5% without ITC

Hello pankaj sir
One of my client registered gst regular dealer for running burger shop. He raise bill to swiggy zomatto.. Can he claim itc for his business.

5% is the rate.
with out ITC

He was a regular dealer. Even for regular dealer we cannot claim itc

For restaurent business GST rate is 5% without ITC. if a restaurent is sitauted in own building or in a stand alone building (not inside any hotel where room rent is 7500 or more or inside a hotel where room rent is less than 7500/-).

if on the other hand it is situated inside an hotel with room rent of Rs 7500/- or more then it can claim ITC with GST at 18%.
