I HAVE RECEIVED FORM 3 FOR VIVAD SE VISHWAS SCHEME AND NOW I HAVE TO FILE FORM 4 .AS THERE IS NO PAYMENT OF TAX ,THERE IS REFUND FOR WHICH I MADE APPEAL.NOW AS DO NOT HAVE TO MAKE PAYMENT THEN WHAT DETAIL SHOULD I PUT IN FORM 4

Under VSV scheme
Any amount paid in pursuance of a declaration made under section 4 shall not be refundable under any circumstances.

Explanation.—For the removal of doubts, it is hereby clarified that where the declarant had, before filing the declaration under sub-section (1) of section 4, paid any amount under the Income-tax Act in respect of his tax arrear which exceeds the amount payable under section 3, he shall be entitled to a refund of such excess amount, but shall not be entitled to interest on such excess amount under section 244A of the Income-tax Act.

I think you should file Form 5
I had same case.

In VSV form 4,

1. give details of taxes (if any) paid earlier i. e. during appeal proceedings for obtaining stay on demand.

2. Attach proof of withdrawal of appeal (OC of application for withdrawal of appeal can be attached)

Hope it helps.

While filling Form 4, an error message is displayed that the date of payment of tax is before the dete of filling Form 1&2 and does not accept the same.

Whereas Form1 & 2 duly been filed and Form 3 is issued against the same though in tat Form 3 against the payment made it is mentioned as :MISMATCHED" only because of the difference in Challan amount and amount filled (interest diff).

Pls suggest the remedy.

e.g. date of payment of tax 7-9-2020 (amount deposited directly by the department from my bank account)    

Form 1& 2 filed on 26-3-21.

Sir, I have not received Form 5. I have paid the tax in the month of January 2020. Also Income tax website is not showing any service regarding Vivad se Vishwas.

Whether the Department has started issuing Form 5?

 

I faced same problem So I approached the Officer and found that in challan instead of Tax on Regular Asst. (Minor Head 400) paid under Self Assessment (300). Better you approach the officer.
