Please note that the abovementioned letter to the registrar will not suffice.
As per the Bombay Public Trust Act, any change in the trust is to be submitted to the Charity Commissioner in the Schedule III of the said Act.
You need to fill relevant details in Schedule III, and get it notarised and stamped of Rs. 100/- and attach the certified copy of the resolution passed in the trustees meeting for name change as well as the relevant minutes of the meeting.

While changing the name of the trust, do we have to get it registered with the income tax department again or just a letter of change of name will do ?
Is there any board circular / clarification on this ?

To change the name of a public trust in Karnataka, what would be the procedure to go about for the same. In karnataka there is no public trusts act yet and (in principle) when there is no public trusts act the general principles of private trusts (Indian Trust Act) will apply.
Also there seems to be no provision in the Indian Trust Act except Section 11 which provides for modification through consent of all the beneficiaries to the trust.
How would the trustees go about changing the name of a public trust in the given situation?

APPROVAL FOR CHANGE OF NAME OF THE SCHOOL FROM ______________ To________________________.
The Chairman informed the members that existing name of our Scholl running under the name and style ____________ is too lengthy and outgoing students find it difficult to fill up the entry forms of various Universities as the number of block in the pre printed form is limited. Therefore both students and parents suggested school management to change the name of the Scholl and accordingly it is proposed to change the name of the school from “________” to “__________” subject to various statutory approvals. He further informed that the change of name of the school as aforesaid does not change the legal status or constitution of the school, nor does it affect any rights or obligations of the school. The Board considered the same and passed the following resolution:
“RESOLVED THAT subject to the approval of Director of Higher Education and subject to all such statutory, regulatory and Government approvals, permissions or sanctions as may be necessary and subject to such conditions and modification as may be prescribed or imposed while granting such approvals and permissions, which may be agreed to by the Board of Trustee of the Trust, consent of the Board be and is hereby accorded to change the name of the school from “____________” to “________”.
RESOLVED FURTHER THAT Mr._______, Chairman of the Trust be and is hereby authorized to do and perform or caused to do or cause to be done all such acts, deeds, matters and things as may be required or deemed necessary or incidental thereto including without limitation if need to be changed and finalizing and executing necessary application, documents, including agreements, power of attorney, deed of assignment and such other documents as may be necessary or expedient in his own discretion and in the best interest of the Trust and to delegate all or any of the power or authorities hereby conferred to any Trustee or any other officer of the School/ Trust or to any advisors, consultants, agent or intermediary as may be deemed necessary to give effect to this resolution.
RESOLVED FURTHER THAT the above said resolutions be handed over to such other authorities certified by the Chairman of the Trust as may be required from time to time”.

Karnataka Government becomes the 3RD State to notify the requirement of Compulsory Gratuity Insurance for fulfillment of provisions of following :-
1. Sub-Section (2) & (4) of Section 4A of The Payment of Gratuity Act, 1972,
2. Subsection (5) of Section 2 Income Tax Act 1961,
3. Part C of Fourth Schedule of Income Tax Act, 1961
4. Rule 98-111 of Income Tax Rule, 1962
5. Chapter II of Indian Trust Act, 1882
6. AS 15 (Revised 2005) & IndAS 19
7. Insurance Act, 1938
The Government of Karnataka has notified above notification to ensure that there will be no default in terms of Payment of Gratuity to Private Sector employees even in case of Bankruptcy of Company as this notification specified that “Employer shall at all times maintain the gratuity trust and gratuity fund, as an Irrevocable System”
The gazetted notification is attached herewith for your kind perusal.
The Karnataka Government has notified the above Rules called “Karnataka Compulsory Gratuity Insurance Rules, 2024 (hereinafter referred as KCGIR, 2024)” on 10th January 2024. The last date for completion of compliance of KCGIR, 2024 is 09.03.2024 (i.e. 60 Days after date of notification).
