Tax queries 509 views 1 replies
Hi
Need clarification on  below: Kindly give me your comments with any section/case-law for the same if any.

There are 3 companies namely A, B & C.

A & C has a common Chairmen.
A & B do not have any direct relation. B is a 100% private owned company
C is 100% subsidiary of company 'B'.

My clarification required - Is Company 'A' and 'B' has any indirect relationship to be considered for the Transfer Pricing purpose.

Thanks & Regards

Yes, Company A,B,C all are associate enterprise as per Sec 92A(1) and (2)(a).

As A and C has common managerial person who participates in functioning of both co and B holds more then 26% of voting power(100% as given above) in C.
