27 December 2008Kindly let me know that during which period of time The Department of have to issue Show Cause Notice U/s 76 only, of Service Tax Law for leving penalty for delay made in deposition service tax amount by the assessee, in a case when an assessee has deposited the service tax amount along with interest part calculated duly thereon.
Pl. post your reply on ASAP basis.

One year from date of filing return under normal period. Five years in the case suppression is invoked.

One year for recover of service tax which has not been paid or short paid but in which provision the time limit for initiation of penalty proceedings has been mentioned.
