Third party export under epcg

Dear Experts

We are going to purchase indigenous machinery under EPCG. We have some queries :

1.    Can we fullfil our export obligation through third party export. If, yes is there any loss to third party who has mentioned my name and EPCG No.  in his shipping bill ?

Actually, we can not directly export, so please help us out. Some body told us that no merchant exporter will mentione our name and EPCG no in his shipping bill. I don't know why ?

DO NOT CHAOS .

EPCG authorization holder can export either directly or through third party (s). Export proceeds are to be realized in freely convertible currency except for deemed exports.

(a)if a merchant exporter is EPCG Authorisation Holder , Name of Supporting Manufacturer will be indicated On shipping bill.

(b) @ the time of export , EPCG authoroisation No. and date shall be endorsed on shipping bill which are proposed to be presented Towards discharge of E.O. as per PARA 5.7.1 OF HAND BOOK OF PROCEDURES VOL-1(20009-2014)

Let us take an example 

Mr. X is EPCG authorization holder. MR. X sells goods to Mr. Y. Mr. Y exports the goods. If. Mr. Y mentions Mr. X name and EPCG no. in his shipping bill then Will Mr. Y be debared of any export benefit under chapter 3 or any other ?

Secondly, What documents will Mr. X take from Mr. Y to fullfill his EO after export.

dear sir,

i have a query regarding fulfillment of specific Export obligation, and average export obligation.

our company has directly imported the machinery ,and  at the time of issuance of epcg license, an average EO also imposed.

the company has not made any export thereafter, and the specific eo fulfilled from third party. but about the fuffilment of average export,

can third party fulfill the average export, as well as specific export obligation., or there is any other procedure to nil the avg EO.

please suggest.

in the case of Pamban Apparel Limited, Aundipatti,  Distt: Theni, Tamilnadu , D.G.FT , DELHI

P.R.Committee approved condonation of block-wise fulfillment of export obligation observing that firm has fulfilled the entire Average E.O. through 3rd party exports.Committee suggested that introduction of policy provisions to ensure that fulfillment of EO through third party exports should not be more than 50% in any case may be examined by DGFT.
