30 June 2014Just wanted to know whether section 195 is applicable for payment to a non resident against services being rendered by him outside india for payer (Public Limited Company). His services are listed as follows:
1) He will assist in setting up Representative office of the payer company in that country.
2) He will assist in opening Bank account of the payer company there.
All the payments against his service fee shall be remitted in AED (Currenty) at UAE only.

Not applicable.
As income accured as well as recevied out site India by non resident.

It will not be applicable. Because Section 195 read with section 9(1)(vii) says clearly that the service must be provided for business in India.
