while preparing the tds return , threre is a column where you need to mention the date of payment & date of deduction... so automatically department ll get to know tht you have deducted tds late.. n as far as auditors are concerned.. while doing audit they ll chck your ledger no!!!.. so it ll b visible frm that itself..

Dear Sonakshi

We have paid this bill on 15th April so there is no point to find out any reason for delayed deduction. ( there is option as stated by you date of deduction/credited)

you are claiming this bill as an expense in year 2014-15 or 2015-16? if in year 2014-15, then tds need to be paid wth interest.. no other way out...

we are claiming this bill in f.y. 2014-15, we are ready to pay interest for late deposit of tds, but we won't to pay interest for late deduction of tds

who told you that you need to pay two different amounts of interest.. you just need to pay interest once..

As per TDS rule Tds needs to be deducted on invoice date or payment date which is earlier.interest for late deduction is @ 1% and interest for late Payment is @ 1.5%.

 

So you will be liable to pay interet @ 1% from invoice date to date of deduction and 1.5% from date of deduction to date of payment

My query is how will department know that we did not deduct tds at the time of credit amount.

as we recd bill on 06.01.2015 and we deducted tds on 31st march 2015.

Hi Pankaj,

Basically it happens that we forget to deduct tds on time and during finalisation of accounts or during audit we came to know that tds has not been deducted on some amount. 

If you had made full payment in april ie rs 1,00,000/- than it is a case of tds not deducted or else if you had made payment in April of Rs 90,000/- than you can show that tds has been deducted in April.

Now different scenario 

Suppose you had made payment of Rs 90,000/- in jan only than you could not show that TDS has been deducted late since while making payment you had deducted TDS.

So in your case you can show Tds deduction date as 31st march.
