11 August 2010A Proprietor export some thing to Germany through Schenker India Pvt Ltd. (Schenker Logistics). Schenker India mooving materials through Jet Air and provide Bill as Air Freight Rs.53,203.00, Charges collect Fees Rs. 1,064.00, Delivery Charges Rs.1,200.00 and also charge Service Tax Rs.148.00. Total Bill Rs. 55,615.00.
Can I deduct TDS from Schenker India? If so, what section 194C / 194H?
Kindly help me.

TDS on Air Freight is not applicable.
Therefore if other charges i.e. fees, delievery charges and service tax in aggregate exceeds limit applicable u/s 194c then TDS shall be deducted otherwise not.
