Tds to be deducted or nott??

Dear Friends,

 

Whether in case of foreign payments TDS has to be deducted on Software license renewals / maintenance charges termed as annual software operational licence fee??


Please support your answers with case laws or sections from the act, if any??

Yes, here TDS is deductible U/s. 195 on payments made to NRI and Form 27Q is to be filed for the quarter under consideration.
