Tds refund

Is their any  way to get tds refund in current year  for a person who hasn't filed income tax return for AY 2009-10.the concerned refund is for the same AY 2009-2010.

is their any way by which assessing officer of income tax can assess such case suo motto  ???? 

(i understand that the date of furnishing return for AY 2009-2010 has gone way back)
