This is 10% (effective from 01 July 2012) under section 194-J(1)(BA)..

If there is employer employee relationship then it will be covered u/s 192B otherwise u/s 194J.

first check the nature of payment made to director . if relationship of employer and employee exists payment will be covered under section 192 B other wise treated as per section 194J( b1)(BA)
