Professional fees paid to forein company
Ordinarily subject to TDS @ 10% plus cess or surcharge as applicable but if DTAA or any other provisions attract as the case may be there may be non applicability of TDS.
Since the payment of professional fees is not to a resident Indian, section 194J @ 10% won't apply.
The applicable section will be 195 (where TDS @ 30% maximum ) however subject much to DTAA provisions.
