it all depends on the nomenclature of the invoice raised by the vendor.
If vendor mentions the invoice is for supply of water at pre fixed rates then TDS would apply.
If on the other hand, the invoice is for sale of water, then no tds.
Any contrary view is please welcome.

Dear Sir
Please share your views if company has entered in to agreement with nearby farmer to purchase water from his borewell. Instead of sending tanker to his premises company laid down a pipe line. Company also provides his electricity to run the water pump.
In this case will it be mere sell of goods transaction?
