22 March 2010A Individual Transporter (Truck owner) issued LR In the name of X Transport Co. and he gave us his PAN card copy. (PAN Is not mentioned anywhere in LR)
We contacted the X Transporter and asked for his PAN. They gave us difference PAN (Owner of X Transport) and inform us A used his LR.
In this case we have to deduct the TDS or not. If yes then credited to whose account A or X
In individual case, how to find out whether PAN is belongs to Name mentioned in LR or not.
Pl advise for the same

If tranasporter have given bill on his own orgnisation name , you have to simply find the such tranporter is sole propritor or not , if sole propritor then he must submit his own pan no. other wise TDS will be deducted. if he is other than sole propritor then he will submit the firm, Company any other entities pan no. if he doen not provide his company , firm etc pan no. you will have to deducted tds under section 194C of income tax act.
