Employer does not deduct TDS on employee salary but in fact deposited employee's tax out of his (employer) own pocket.
Now can employer be held responsible that he didnt deduct TDS?
The govt got its tax.
The amount paid as tax by employer will be added to total income of employee while employee files his ITR.

Tds deducted and deposited is related to TDS return,
although tax has been deposited by any mode but tds return is required to submit with effect of payment of tax
if there is no default in respect of tds return, then ok
