Tds on rental payment

Hi,

I am working in mobile tower company. We are paying monthly rental payment to land lords whereever we built the towers.

In which, one of the land lord was not encashed cheque for the past one year amounting to Rs.1.60Lacs which consists of 12 months cheque. Now, I want to release the rental after verifying my books. Pelase help me out below my queries,

  • Whether this land lords will cover under TDS limit, since payout for the current financil year will be more than Rs.1.80 lacs (Rs.1.60 Lacs arrears + curren year rental)
  • If I am going to pay the arrears rental to his legal heir (Due to origingal land lord expired). Whether, new land lord, will it attract TDS?

I think yes it will attract tds provisions.
But you can check if you have passed a straight entry i.e. debiting the rentals and crediting the bank or you have credited the landlord a/c and then paying the rent by debiting his account.

If you have credited his account earlier then you will not need to deduct tds .
