TDS on such transaction will be deducted as per provisions of sec 195 or DTAA between India & Hongkong.

tax rate 40%+sc+e cess(i am not sure about the tax rate.

Sec 195. payment of sum to a non- resident
receipient is a non-domestic company, hence 40% + ec + shec
if payment exceeds 1 crore than surchargea also will be applicable

Is TDS Applicable in case of payment made through issue of equity shares for the technical advice obtained from foreign company (i,e a russian company) if yes then would it be applicable u/s 195 or 194j.
