TDS on Marketing Services

A firm undertakes marketing activities for another company (thus being a marketing agent) and collects payments from clients on behalf of the Company. As per the agreement, the marketing agent forwards the amount collected from clients to the Company after deduction of its Commission. In such case, who deducts and deposits the TDS and under what section?

It is nature of Contract therefore TDS is to be deducted u/s 194C....

Okay, but who can finally deposit the TDS in this unique situation?

Company will be liable to pay TDS ,

The liability to deduct TDS will arise as and when company receives creditnote  or actual payment from firm.

 So in this case Company must collect his Net of Commission + amount of TDS....

And Liability to Pay will be withing 7th day of next month from the date of Creditnote or actual payment of amount.... 

 

Ofcourse deductor is liable..
