TDS on Foreign Remmitances

As per new circular the Provision of TDS @ 20 % where PAN is not availale will apply to all Foreign Remmittances on and after 01.04.2010. Please clarify whether all non-residents receiving payments from India are requried to apply for and get. What is the position if in a transaction like Import / Services Outside India where TDS is not applicable at all. 

In case of Imports some Companies are submitting 15 CA & CB and some Compnies are not, giving the reason that 15 CA and 15 CB are not applicable in case of Import transactions and where payment is made through form A1. Some professionals have given the opinion that 15 CA and 15 CB are applicable where remmitances are made through form A2.

All banks are insisting on getting a CA certificate for remittances on  import of goods (as per the RBI circular).The importer has to prove that there is no Permanent Establishment  of the foreign entity in India.Only then TDS is not payable
