TDS on Fees received by a dentist

A free lancer doctor has provided some dental service, from one of the hospital where he was called for an operation, he has raised a bill of Rs. 47,000/- out of which Approx Rs. 30,000/- has been spent on purchasing the equipments which has been used for this purpose thus the net amount of professional fees that has been received by the doctor is only approx Rs. 17,000/-.

The hospital is saying that TDS will be deducted on full amount that is Rs. 47,000/- but the doctor is arguing that the TDS should be deducted only on Rs. 17,000/- (the net amount of Professional fees).

Can any one tell me on what amount TDS will be deducted?????

Thanks in advance

well tds have to deduct on gross amount hence tds should be deduct on Rs.47000/- but ask to accounts dept. of hospital that birficate this amount and show only professional fees of Rs.17000/- if they don’t do like this ask to issue two separate bill of below Rs.30000/-…………

if they already have deducted tds than at the timing of ITR you could take refund..

So if they give a seperate bill then TDS will be deducted only on Rs. 17,000/-?????

no… tds will no deduct … tds on professional fees always deduct when threshold limit of Rs.30000/- crossed in single transaction to take two bills in different date..

thanks a lot........
