If payment is made to Foreign Party in Foreign exchange for machinery purchase which includes Erection and Commissioning Charges also in foreing exchange only ( Payment thru LC) .Whether TDS is applicable on erection and commissioning ?

Income deemed to accrue or arise in India deduct TDS U/S 195 for erection and commissioning and service tax also to be paid for this transaction
