Dear All
A Company is paying Building Maintenance to "Building Mtc. Society". A per lease agreement with the lessor, it is provided that Building maintenance charges to be paid to Building Mtc. society.
Q. Whether TDS should be deducted on such Building Mtc. charges?

Dear Sir,
As per the agreement if any amount paid towards maintenace of building, TDS is required to be deducted u/s 194I.

it is a building maintenance contract so TDS is applicable under 194C if it crosses the prescribed limit of 2OK

Dear Uday Sir,
If lease agreement shall provide payment of Annual maintenace charges of building the same shall be chargeable to TDS u/s 194I only and not u/s 194C. As repair & maintenance charges of building arises under the purview of Section 194I.
