TDS NOT DEDUCTED

if a payer doesn't deduct tds on which entity have to deduct Tds for F.Y 16-17, and says that he will deduct the same in next year. is there any provision to follow by payee.?? or payee can file ITR and claim Tds next year in which entity will deduct

As per section 40(a)(ia) Entitiy expense is disallowed to the extent of 30% and there is a exception for this:

If the payee has vouluntarily furnishes his ROI and paid the tax due on such income then no disallowance is attracted.

In your case u can pay tax and file ITR

no one can deduct TDS in next year, they have to dedcut tax in same year, his expenses will be disallowed, in your case you file your return and pay taxes.
