example : an individual had audit their books for fy 2009-10
now their liablity to deduct tds for fy. 2010-10
but not in audit for fy 2010-11
so, now their liablity to deduct tds or not?

Yes they are liable to deduct tax in F.Y. 2010-11 as tax audit was applicable in F.Y. 2009-10. But again in 2011-12 no TDS liability would arise as no tax audit applicable in F.Y.2010-11.
