whether late fee is applicable on filing of nil declaration of tds after due date?

If TDS is Nil There is no need for the filing of TDS return

it is not mandatory to file Nil TDS return but however you have to file a declaration for non-filing of TDS return.
I think there is late fee also.

what I mean is filing of declaration becomes mandatory in lieu of non-filing of Nil TDS return.

one of two is must.
